Frankie's Dog Club Terms and Conditions 1. Relationship and Responsibilities 1.1. It is expressly understood that the Client retains the services of the dog walker/trainer as an Independent Contractor and not as an employee. 1.2. The dog walker/trainer undertakes to perform the agreed upon services in an attentive, reliable, caring manner and subject to the Association of Professional Dog Walkers and Sitters Code of Practice of which the dog walker/trainer is a member, and the Client undertakes to provide all necessary information to assist in this performance. 1.3. The dog walker/trainer undertakes to notify the Client of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog. 1.4. The dog walker/trainer will supply and be equipped with waste bags and will duly remove the dog’s faeces from all public places. 1.5. The dog walker/trainer reserves the right to walk other compatible dogs at the same time but undertakes to limit the number of dogs walked with one person to 4 (four) and accordance to Association of Professional Dog Walkers and Sitters (APDWS) code of practice. 1.6. The dog walker/trainer shall not be obliged to perform any other duties except those specified in this contract or agreed with the Client during the introduction session. 2. Equipment 2.1. The Client will provide suitable harnesses, collars and or leads. 2.2. The dog walker/trainer reserves the right to refuse the use of aversive equipment that would cause fear, anxiety, or distress for the dog. This includes, but is not limited to choke chains, prong collars, electric collars, anti-bark collars that emit citronella or high-pitched sounds, shaker cans, spray bottles, or slip leads for prolonged periods. 3. Compensation 3.1. The dog walker/trainer shall be paid the amount specified in the services section on the Frankie’s Dog Club website. 3.2. Invoices shall be payable via bank transfer by the Client within 5 working days of receipt to: Francesca Sykes Monzo Bank Sort code: 04-00-04 Account Number: 15460574 4. Cancellation 4.1. Cancellation by the Client of scheduled walks/training sessions with less than 24 hours’ notice may be charged at the full rate or rescheduled at the discretion of the dog walker/trainer. 4.2. Where the dog walker/trainer as sole proprietor needs to cancel a scheduled walk or training session due to unforeseen circumstances, they will endeavour to provide time as practicable for the Client to source alternative care for their dog. 4.3. Should any dog become aggressive or dangerous, the dog walker/trainer may terminate this Contract with immediate effect. 4.4. Any wrongful or misleading information provided by the client about their dog on the webform or during any subsequent written or verbal communication may constitute a breach of terms of this Contract and be grounds for instant termination thereof. 4.5. Termination under the circumstances described in 4.4 or 4.5 above shall not entitle the Client to any refunds nor relief of any outstanding payments due. 5. Liability 5.1. The dog walker/trainer accepts no liability for any breach of security or loss of or damage to the Client’s property if any other person has access to the property during the term of this agreement. The dog walker/trainer will however take all reasonable steps to ensure our Clients premises are secure upon entry and leaving. 5.2. The dog walker/trainer shall not be liable for any mishap of whatsoever nature which may befall a dog or caused by a dog who has unsupervised access to the outdoors. 5.3. The Client shall be liable for all medical expenses and damages resulting from an injury to the dog walker/trainer caused by the dog as well as damage to the Client’s property. 5.4. The dog walker/trainer is released from all liability related to transporting dog(s) to and from any veterinary clinic or kennel, the medical treatment of the dog(s) and the expense thereof. 5.5. The walker/trainer is not liable for the Client’s misinterpretation of training or behavioural advice. The dog walker/trainer believes advice to be true and accurate as at the time it is given but gives no assurances or warranty regarding the accuracy, currency, or applicability of this advice in relation to alternative circumstances during which the dog walker/trainer is not present. 6. Indemnification The parties agree to indemnify and hold harmless each other as well as respective employees, successors and assigns from any and all claims arising from either party’s wilful or negligent conduct. 7. Emergencies In the event of an emergency, the dog walker/trainer shall contact the Client at the numbers provided on the Information Form to confirm the Client’s choice of action. If the Client cannot be reached timeously, the dog walker/trainer is authorised to: 7.1. Transport the dog(s) to the listed veterinarian; 7.2. Request on-site treatment from a veterinarian; 7.3. Transport the dog(s) to an emergency clinic if the previous two options are not feasible. 8. Security The dog walker/trainer warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Client and to return same to the Client at the end of the contract period or immediately upon demand. 9. Relaxation of Terms No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. 10. Whole Agreement This Contract constitutes the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained therein. Any alteration to this agreement must be in writing and signed by both parties. 11. Assignment No party may assign any of its rights or delegate or assign any of its obligations in terms of this Contract without the prior written consent of the other party, except where otherwise stated. 12. Binding Effect The terms of this Contract shall be binding upon and accrue to the benefit and be enforceable by either party’s successors, legal representatives and assigns. 13. Responsibilities of the client The Client shall be responsible for the proper upkeep of their dog’s vaccinations, boosters and preventative flea and worming treatments. The Client shall also be responsible for ensuring contact details stated on the microchip and tag are up to date, which is their legal obligation.
